افتراضي What is Shighaar marriage?


In The Name Of Allah The Beneficent The Merciful

Alhamdu llah wa salatu wa salam a`la rasul llah wa a`la alèeh wa sahbe ajmain


al-shighaar


This marriage that (Two men agreed that each of them would give his sister or his daughter in marriage to the other)
Ex:: you marry my sister and I marry your sister
It is void ( haraam), and was forbidden by the Prophet muhammed(peace and blessings of Allaah be upon him).

In al Saheehayn hadeeth ib´umer the Messenger of Allaah (peace and blessings of Allaah be upon him) forbade shighaar
عن ابن عمر رضى الله عنهما أن رسول الله صلى الله علية وسلم نهى عن الشغار) فى الصحيحين

In saheeh muslim The Prophet muhammed(peace and blessings of Allaah be upon him) sayes “ There is no shighaar in Islam”
قال رسول الله صلى الله عليه وسلم(لا شغار فى الاسلام)رواه مسلم

Same of scholars sayes when thes kind of marriage with dowry(maher) it is valid(hallal), But Shaykh ;Abd al-‘Azeez ibn Baaz says this is Void (haraam) too.
Because Prophet Muhammed (peace and blessings of Allaah be upon him) did not differentiate between that in which a maher is mentioned and that in which no maher is mentioned.
As hadeeth of Ibn ‘Umar radeya allah a`nhuma in interpretation Shagari
“ man gives his daughter in marriage to another on the basis that he will give
him his daughter in marriage with no dowry (mahr) between them.
(ان يزوج الرجل ابنته على ان يزوجه الاخر ابنتة ليس بينهما صداق)
These words “with no dowry” The scholars sayes it is from Naafi’(the freed slave)who transmitted it from Ibn ‘Umar and are not the words of the Prophet(peace and blessings of Allaah be upon him)
and the right hadeeth Abu Hurayrah in muslim
عن ابي هريرة رضى الله عنه قال(نهى رسول الله صلى الله عليه وسلم عن الشغار وزاد ابن نمير والشغار ان يقول الرجل للرجل زوجني ابنتك وازوجك ابنتي او زوجني اختك وازوجك اختي ) صحيح مسلم
Abu hurayrah” The Messenger of Allaah (peace and blessings of Allaah be upon him) forbade shighaar. Ibn Numayr added: Shighaar means when a man says to another: “Give me your daughter in marriage and I will give you my daughter in marriage, or give me your sister in marriage and I will give you my sister in marriage.”

Why is haraam ?
Because the Messenger of Allah(peace and blessings of Allaah be upon him) forbade him for the injustice to women and corruption.And Allah said in alquran alkarim
( وَمَا آتَاكُمُ الرَّسُولُ فَخُذُوهُ وَمَا نَهَاكُمْ عَنْهُ فَانْتَهُو) سورة الحشر
interpretation of the meaning
“And whatsoever the Messenger (Muhammad) gives you, take it; and whatsoever he forbids you, abstain (from it)”
And same time forcing women to marry those who do not want it only for interest of the Patriarchs to the benefit of women and that injustice(doulam)for her, and deprives women of their right of dowry (maher)

What is the solution?
1_ before the consummated
this Marriage is invalid, and We must separet the,
And what happened at the time of the caliph Mu’aawiyah (may Allaah be pleased with him) because al-Abbaas ibn Abd-Allaah and Abd al-Rahmaan ibn al-Hakam both mentioned a dowry, but Mu’aawiyah (may Allaah be pleased with him) he ordered that they be separated and said“This is the shighaar which the Messenger of Allaah (peace and blessings of Allaah be upon him) forbade.
2_ after the consummated
When she loves him and he loves her theonly way is for them to do a new marriage contract with a wali (guardian) and a new mahr, and with two witnesses.
When he does not loves her or she does not loves him , he has to divorce her with one talaaq. and she will have the right to marry someone else once her ‘iddah is over, and if the husband wants to take her back he can do it with a new marriage contract when she want .
